Sexual Assault Investigation Leads to DUI Arrest in Missoula
Missoula, MT (KGVO-AM News) - On August 11, 2026, at approximately 9:35 pm, Missoula Police Department officers were dispatched to Otis Street for a report of a sexual assault. Dispatch advised that Jane Doe called 911 and reported that a male named Dillon grabbed her breast and then walked away. She reported that his actions made her feel uncomfortable.
Upon arrival, officers spoke to Doe and attempted to locate Dillon. While an officer was initially speaking to Doe, she pointed out Dillon leaving the apartment parking garage in an orange 2008 Mitsubishi Eclipse onto Otis Street. The officer noted that Dillon was traveling rapidly and initially had no lights on. The officer radioed fellow officers and went to his patrol car to pursue the suspect while the other officer spoke to Doe.
A short time later, the officer conducted a traffic stop on Dillon. He had caught up to the vehicle turning onto Rodgers from Otis Street and had his emergency lights activated. The driver yielded shortly after turning. The officer approached the vehicle and asked the driver to exit. The driver was identified as 49-year-old Dillon Diemert. The officer informed Dillon of the reason for the contact and proceeded to investigate the sexual assault. Dillon denied committing any sexual assault.
Sobriety Tests: Signs of Impairment
During the investigation, the officer noted a strong smell of an alcoholic beverage, a slight slur to his speech, frequent repetition of statements and information, and a frequent need for the officer to repeat the same instructions or information to him. Dillon struggled to retain short-term memory information. The officer also noted his eyes were watery in appearance and he often displayed a dazed expression. The officer also noticed that while Dillon was standing in front of the patrol vehicle, he was frequently leaning on it and was swaying back and forth while standing.
The officer began a DUI investigation and asked Dillon if he would perform the Standardized Field Sobriety Tests. The officer observed 6 out of 6 clues on the horizontal gaze nystagmus test and 8 out of 8 clues on the walk and turn test. After failing the walk and turn test, Dillon made a hopping motion and claimed he had gout. When the officer attempted to conduct the one-leg stand test, Dillon became very argumentative and refused to do any further testing. He also informed the officer that he was not going to submit to any breath testing.
Then Dillon was placed under arrest. The officer informed Dillon that he would be transported to St. Patrick Hospital, where he would apply for a search warrant for his blood. The officer had confirmed that Dillon had 3 prior convictions for DUI, all of which were from Montana agencies.

The officer read Dillon the preliminary alcohol screening test advisory and the implied consent advisory even though he had already refused. He confirmed his refusal to both. The officer was ultimately granted a search warrant for blood, and a blood draw was conducted at St. Patrick’s Hospital. Thereafter, Dillon was transported to the Missoula County Detention Facility.
Dillon is currently being charged with felony DUI and sexual assault, first offense. His bond was set at $10,000.
