At around 10:30 Friday night, Missoula police received a call from a concerned citizen who had observed an adult female at a convenience store in the 500 block of North Orange Street. The complainant reported that the female appeared to be intoxicated and had gotten into a vehicle. Police Public Information Officer Travis Welsh explains.

“The complainant reported that the driver of the vehicle had actually moved it out on to the street and it was located at the intersection of North 3rd and Grant,” Welsh said. “When the officer arrived, he made contact with the female owner of the car who was identified as 27-year-old Sierra Schmaus. Through the course of their contact, the officer determined that Schmaus had been driving under the influence of alcohol and she was placed under arrest.”

During the course of the arrest, Welsh says Schmaus resisted and actually assaulted one officer.

“When she got into the car, rather than swing her legs in, she started kicking at the officers and she actually kicked one officer in the side of the head,” Welsh said. “She refused to identify herself and was transported to the jail. She is being held for a count of DUI, assault on a peace officer, resisting arrest, and obstructing a peace officer.”

According to the report, Schmaus kicked the officer multiple times before he was able to gain control of her feet. The officer did not seek medical attention.
