23 year-old Robert Ervin is in the Missoula County Jail on $100,000 bond after allegedly breaking into his wife's home on Tuesday night, assaulting her, and spraying her, his two year-old child and his sister with Mace.

Ervin appeared in Missoula Justice Court, where he was charged with four felonies, aggravated burglary, theft, assault on a minor and failure to register, in addition to three misdemeanor charges of partner of family member assault, which, according to Judge Karen Orzech, constitutes another felony.

According to court documents, Ervin allegedly kicked in the door of his wife's home on the 100 block of Turner Court early Tuesday morning and attempted to steal his wife's cash. In the process, he assaulted her and sprayed the entire household with Mace, which resulted in everyone in the house being sent to the emergency room at St. Patrick Hospital, including a two year-old child.

Ervin was found later that night passed out on a lawn at a residence on Catlin Street.

Deputy Missoula County Attorney Selene Koepke asked Judge Orzech for high bail.

"The State of Montana is asking for $150,000 bail in this case," Koepke said. "The State believes the defendant is a danger to the community. He is currently on probation for two felonies, both of which he was convicted of just last year. He was convicted of assault, and another assault on a peace officer, he has tested positive for meth, and he admitted to Detective Lear that he was high on meth when he committed this offense."

Judge Orzech, noting that Ervin was currently living at the Poverello Center, set bail at $100,000. His next court appearance will be September 9.
